Official Rules For The 2012 Portland International Auto Show Sweepstakes

OPEN ONLY TO INDIVIDUALS WHO, AT THE DATE OF ENTRY, ARE AT LEAST 18 YEARS OLD, LEGAL RESIDENTS OF THE STATE OF OREGON OR ONE OF THE FOLLOWING SW WASHINGTON COUNTIES: CLARK, COWLITZ, LEWIS, SKAMANIA, WAHKIAKUM, OR PACIFIC WITH A VALID DRIVERS LICENSE AT THE TIME OF ENTRY AND HAVE NOT WON ANOTHER SWEEPSTAKES OR CONTEST ADMINISTERED BY SPONSOR IN THE PREVIOUS SIX MONTHS.

1. PROMOTION PERIOD: Promotion begins December 1, 2011 and ends Sunday, January 29, 2012 at 2:00 p.m. when all entries must be received.

2. ELIGIBILITY: This sweepstakes is only open to individuals who, at the date of entry, are at least 18 years old, legal residents of the State Of Oregon or one of the following SW Washington Counties: Clark, Cowlitz, Lewis, Skamania, Wahkiakum, or Pacific with a valid driver’s license at the time of entry and have not won another sweepstakes or contest administered by Sponsor in the previous six months. Officers, directors, members and employees of the Sponsor, the judging organization (if applicable) or any other party associated with the development or administration of this Promotion and the immediate family (i.e. parents, children, siblings, spouse) and persons residing in the same household, as such individuals are not eligible to enter or win this Promotion. This Promotion is void outside Oregon and Washington and where prohibited.

3. HOW TO ENTER: Entry may be made electronically or via paper entry form. Entry forms (once per week per household) are available in the Portland Tribune, Beaverton Valley Times, The Times, West Linn Tidings, Lake Oswego Review, Oregon City News, Clackamas Review, Outlook, Sandy Post, Estacada News, Forest Grove News-Times and the South County Spotlight through Wednesday, January 25, 2012. Entry forms may be picked up at or mailed to Pamplin Media Group, 6605 SE Lake Road, Portland, OR 97222. Mailed entries must be received at the Pamplin Media Group by noon, Thursday, January 26, 2012. Entries may be submitted at the Portland International Auto Show at the Portland Tribune/Community Newspaper exhibit during show hours Thursday, January 26 10 a.m. to 10 p.m., Friday, 10 a.m. to 10 p.m., Saturday, 10 a.m. to 10 p.m. and Sunday 10:00 a.m. to 2:00 p.m. Paid admission is not required for entry form pick-up or entry form submission. On Sunday, January 29, 2012 all entry forms must be submitted by 2:00 p.m. for that day’s finalist drawing. Mechanically reproduced entries are not allowed. Sponsors are not responsible for lost, late, damaged, illegible, incorrect, incomplete, misdirected or mutilated entries.

4. WINNER SELECTION NOTIFICATION: One (1) potential finalist will be drawn at 8:00 p.m. on the first three days of the sweepstakes and 2 p.m. on Sunday, January 29, 2012. These four (4) potential finalists will be notified immediately via the phone number provided on the giveaway entry form and will be required to be present at the Oregon Convention Center for the grand prize drawing to be held at 4:00 p.m. on Sunday, January 29, 2012. In the event a potential finalist is ineligible, unavailable, or cannot be reached, another name shall be drawn until four (4) finalists are present for the grand prize drawing. The potential finalists will not be charged admission to the show for the final drawing. The grand prize drawing will be conducted as follows. Each finalist will draw a key from a bowl with keys numbered one (1) through four (4) inside. Each finalist will then try their key in the numerical order drawn with number one (1) going first and number four (4) going last to see whose key actually opens the grand prize car’s door. The finalist whose key opens the door will be the grand prizewinner.

5. PRIZE DESCRIPTION: There will be one (1) grand prizewinner. The winner will receive a 2012 Honda Accord LX Sedan. The approximate retail value of the prize is $22,950. Insurance, license and registration fees are not included.

6. TAXES: All federal, state and/or local income and other taxes, transportation costs and registration and licensing fees, if any, are the winner’s sole responsibility.

7. ODDS OF WINNING: The odds of winning this Promotion depend on the number of eligible entries received.

8. NO PRIZE TRANSFERRED SUBSTITUTION: No prize or any portion thereof is transferable or redeemable for cash. Any portion of the prize that is not used is forfeited. No substitutions for prize except by Sponsor, in which case a prize of equal or greater value will be substituted.

9. CONSENT AND RELEASE: By entering the Promotion, each entrant releases and discharges the Sponsor, judging organization (if applicable) and any other party associated with the development or administration of the Promotion, their parent, subsidiary, and affiliated entities and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, transferees and assigns (collectively, “Sponsor Entities”) from any and all liability whatsoever in connection with this Promotion including without limitation legal claims, cost, injuries, losses or damages, demands or actions of any kind (including without limitations personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light collectively “Claims”). Except where prohibited: (i) acceptance of a prize constitutes the consent of any winner, without further compensation, to use the name and likeness of such winner for editorial, advertising and publicity purposes by the Sponsor and/or others authorized by the Sponsor (ii)acceptance of a prize constitutes a release by any winner of the Sponsor Entities of any and all Claims in connection with the administration of the Promotion and the use, misuse or possession of any prize (iii) potential winner may be required to sign an affidavit of eligibility (including social security number) and a liability /publicity release and (iv) if prize involves travel or activities, any potential winner and travel companion (if applicable) may be required to execute release of the Sponsor from any and all liability with respect to participation in such travel/activities and/or use of the prize. Affidavits and releases must be returned within (10) days from the day that Sponsor first tries to notify the potential winner. If winner is deemed to be a minor under the jurisdiction of his/her residence, the prize will be awarded in the name of his/her parent or legal guardian who must execute necessary affidavit and release and, if applicable, must accompany winner on the trip (no additional travel expenses will be awarded should a parent or legal guardian be required to accompany the winner on the trip).

10. DISCLAIMERS: (i)Entries that are lost, late misdirected, incorrect, garbled or incompletely received for any reason, including by reason of hardware, software, browser or network failure, malfunction, congestion or incompatibility at Sponsor’s servers or elsewhere will not be eligible. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider or other organization (e.g., business, educational institute) that is responsible for assigning email addresses for the domain associated with the submitted email address. (ii) Sponsor, it its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the web site. Use of bets or other automated process to enter is prohibited and may result in disqualification at the sole discretion of the sponsor. (iii) Sponsor further reserves the right to cancel, terminate or modify the Promotion if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort. (iv) Sponsor Entities are not responsible for errors in the administration or fulfillment of this Promotion including without limitation mechanical, human, printing, distribution or production errors and may modify or cancel this Promotion based upon such error at the sole discretion without liability (v) SPONSOR ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR LAW, AS REGARDS THIS PROMOTION OR THE MERCHANTABILITY, QUALITY OR FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY PRIZE OR ANY COMPONET OF ANY PRIZE. (6) CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIC LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION REASONABLE ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

11. APPLICABLE LAWS AND JURISDICTION: This Promotion is subject to all applicable federal, state and local laws and regulations. The laws of the State of Oregon shall govern issues concerning the construction, validity, interpretation and enforceability of these Official Rules. All disputes arising out of or connected with this Promotion will be resolved individually and without resort to class action, exclusively by a state or federal court located in the State of Oregon, Multnomah County. Should there be a conflict between the laws of the State of Oregon and any other laws, the conflict will be resolved in favor of the laws of the State of Oregon. All judgments’ or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Promotion and shall not include any indirect, punitive, incidental and/or consequential damages.
